What is Tapu ? What are the Types of Tapu?

If you want to buy a property , you must know several important and basic points about the subject of tapu  and their types and the features and characteristics of each type. So, what is the Tapu that interests those who want to own property? How many types of tapu are there?

What is the Tapu ?

Tapu is a written and official document issued by the Land Registry Office, that proves the ownership of the property for the legal owner with the type and location of the property, in addition to its area and detailed and archived information about it , and considered valid in the legal field until any irregularity is proven. There is a Tapu for each real estate. All information about the real estate is included in this title deed document.

What are the Types of Tapu?

There are three different types of title deed for real estate. These are  easement bond (kat irtifakı tapusu), Full title deed (kat mülkiyeti tapusu ) and share title deed (hisseli tapu).         In addition to being aware of the colors of the title deed, people who want to own a property must know these deed types, which differ according to the current structure or ownership of the immovable.

Types of title deeds and their descriptions are as follows;

Kat irtifakı tapusu (Easement bond)

Kat irtifakı tapu is established on buildings that have not yet started or are in the construction phase. İt is a title deed that records each section of the property separately so that a suitable project is planned for construction on an allocated plot of land, then approval is taken for construction, and then the project is divided into independent sections, such as apartments within the building. For each section of the real estate, a special deed is organized showing the location of the independent division and its information, without considering whether the project has been started or not. The building, which has the easement bond is registered in the  Land Registry Office, therefore it has an official character. This type of document proves the full ownership of the property of the person who owns it. In addition, banks give housing loans if a person wants to buy a house from a building that has a kat irtifakı tapu.

Kat mülkiyeti tapusu (Full title deed)

Kat mülkiyeti tapu  it is a document that records the ownership of real estate after the completion of its establishment completely, and designates the independent sections in them, with obtaining approval to use each section independently, and each section is organized for its own full title deed, which proves the ownership of the bondholder over the independent section in the aforementioned building.

Kat mülkiyeti tapu  contains the number of the apartment or independent section, its location in the building, and its share of the land on which the building is built.

Buildings whose construction is legally completed and for which there is an iskan are transferred from the easement bond  “kat irtifak” to a full title deed “kat mülkiyet” .

This  is the most suitable type of title deed for people who want to buy a property with a housing loan..

Hisseli tapu (Shared title deed)

This type of bond is based on a partnership system between a number of owners of the same property. Hisseli tapu, does not show the share of landowners in the overall area, In other words, it is not clear which area belongs to whom in this deed document. Everyone has a common share in the immovable. The owners make the division of property by agreement among themselves. The value of immovable properties with shared title deed is lower than other properties. There are difficulties in selling the real estate that has this title deed. Banks do not give loans for a property that has a shared title deed, If the person wants to buy a property with a mortgage loan.
